Q: If people vote No and this amendment is defeated, will gay marriage be legal in Minnesota?
A: No. This is a common misperception about the marriage amendment. Marriage is already defined as between one man and one woman in state statute. Defeating this amendment would simply keep freedom-limiting text out of our state constitution.
Q: If gay marriage is already illegal in the state of Minnesota, why would it matter if this amendment passed?
A: While marriage is already defined as one man and one woman in the state of Minnesota, future generations have the opportunity to revisit this law and we can evolve over time. If this amendment were to pass, our state constitution would be forever altered to ensure that no future conversations could take place on this topic without another costly amendment fight.
Q: If this amendment is defeated, won’t “activist judges” attempt to redefine marriage in Minnesota?
A: This is a common rallying cry amendment supporters use to work up their base, however, there is no indication that Minnesota courts are interested in redefining marriage.
